Term Time only? The GMB can help you to make sure you are getting paid correctly!

The GMB, the trade union for schools support staff, is helping term time only staff get the pay they are entitled to.

 

Following a recent court ruling you may be entitled to back dated pay going back at least two years.

 

Your employer uses a formula to determine your pay. Within that formula will be a section that calculates the amount of holiday pay you are entitled to. As a term time only worker your holiday pay is included in the pro rata’d pay which you receive monthly.

 

The ‘Brazel’ case said that *ALL* elements of your term time only pay should be included in the holiday pay element of your pay – this includes Overtime, enhancements (e.g acting up as an HLTA or additional ad hoc hours e.g in an after school or breakfast club)

An example of this is:

Michelle has worked as a level 2 TA at Robin Hood Primary School for 3 years; she has a contract for this role for 32 hours a week, 39 weeks of the year, term time only. After a year and a half working at the school Michelle took on extra hours in the breakfast club. The breakfast club is run by the school and Michelle was never given an additional contract for these hours.

Michelle is entitled to holiday pay accrued on the hours she has worked in the Breakfast Club but has not received this. Michelle contacts her local GMB branch about this issue who help her draft an email to her line manager. Michelle also asks others in her school and finds out her colleagues are in a similar position. The GMB organise a meeting in Michelle’s school to talk to the support staff and helps them to correct their holiday pay and win back dated holiday pay (going back two years) for Michelle and her colleagues.
